Terms of Service

These Terms explain the rules, responsibilities, and limitations that apply when you access or use Delphi Verify.

1. Acceptance of Terms

By accessing or using Delphi Verify ("Delphi Verify", "we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

You represent that you have the legal capacity to enter into a binding agreement under applicable law.

2. Description of the Service

Delphi Verify is a digital evidence verification platform that allows users to:

  • Capture images through a supported mobile application;
  • Generate evidence packs containing one or more images;
  • Record associated metadata such as timestamps, location data, device verification status, and integrity information;
  • Generate public verification codes and public verification pages;
  • Anchor cryptographic proofs to public blockchain networks;
  • Verify evidence integrity through cryptographic and technical validation mechanisms.

Delphi Verify provides technical tools for evidence collection, integrity verification, and public verification. Delphi Verify is not a law firm, not a notary service, not a court authority, and does not guarantee that any evidence will be accepted by any court, government authority, regulator, insurance company, or third party.

3. User Responsibilities

You are solely responsible for:

  • All content you capture, upload, publish, or share through the Service;
  • Obtaining any permissions, consents, or authorizations required to capture images, videos, location data, or personal information;
  • Ensuring that your use of the Service complies with applicable laws and regulations;
  • Maintaining the confidentiality of your account credentials.

Prohibited uses

You agree not to use the Service to:

  • Violate any law or regulation;
  • Infringe intellectual property rights;
  • Violate privacy rights of third parties;
  • Harass, defame, threaten, or harm others;
  • Commit fraud or facilitate fraudulent activity;
  • Misrepresent facts or create misleading evidence;
  • Attempt to circumvent security, attestation, liveness, or anti-fraud systems.

4. Public Verification and Published Evidence

Certain evidence packs may generate public verification codes, public links, or publicly accessible verification pages.

By publishing an evidence pack, you acknowledge and agree that:

  • Information contained within the published pack may become accessible to anyone possessing the public code or link;
  • Images, timestamps, location information, hashes, verification status, and related metadata may be displayed publicly;
  • You are solely responsible for ensuring that no confidential, sensitive, private, or unauthorized third-party information is included in published content.

Delphi Verify is not responsible for information voluntarily disclosed by users through public verification pages.

5. Blockchain Records

Delphi Verify may anchor cryptographic proofs to public blockchain networks, including but not limited to Base Mainnet.

You acknowledge and agree that:

  • Blockchain records are public by nature;
  • Blockchain records may be permanent and effectively impossible to modify or delete;
  • Delphi Verify cannot guarantee removal of information once anchored on a public blockchain;
  • Blockchain systems operate independently from Delphi Verify and are outside our control.

6. Device Verification and Anti-Fraud Systems

Delphi Verify may use technical measures including but not limited to:

  • Apple App Attest;
  • Device verification systems;
  • Guided capture workflows;
  • Liveness detection;
  • Fraud detection models;
  • Artificial intelligence systems;
  • Integrity validation mechanisms.

These systems are intended to improve trust and authenticity but do not guarantee detection of all fraudulent, manipulated, malicious, or deceptive activity.

Delphi Verify makes no representation that any evidence pack is free from fraud, manipulation, or falsification.

7. Artificial Intelligence Processing

Certain anti-fraud and verification functions may utilize artificial intelligence systems and machine learning models.

AI-generated assessments are probabilistic in nature and may produce false positives, false negatives, inaccurate classifications, or incomplete conclusions.

Users acknowledge that AI-assisted verification is only one component of the overall verification process and should not be treated as definitive proof of authenticity.

8. Data Retention

Delphi Verify may retain different categories of information for different periods.

Temporary verification materials, including liveness recordings and related media, may be deleted after the retention period established by Delphi Verify.

Certain records may be retained indefinitely for purposes including:

  • Integrity verification;
  • Auditability;
  • Compliance;
  • Security;
  • Fraud prevention;
  • Preservation of publicly published evidence;
  • Preservation of blockchain-linked verification records.

Account deletion may result in anonymization or removal of user-controlled account information while preserving verification records necessary to maintain historical integrity of published evidence.

10. Third-Party Services

The Service may rely on third-party providers including cloud infrastructure providers, blockchain networks, artificial intelligence providers, authentication providers, and other technology partners.

Delphi Verify is not responsible for outages, failures, interruptions, inaccuracies, or actions caused by third-party services.

11. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

To the maximum extent permitted by law, Delphi Verify disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of:

  • Merchantability;
  • Fitness for a particular purpose;
  • Non-infringement;
  • Accuracy;
  • Reliability;
  • Availability;
  • Security;
  • Legal admissibility of evidence.

We do not guarantee uninterrupted operation, error-free functionality, or continuous availability of the Service.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Delphi Verify, its owners, officers, employees, contractors, affiliates, and partners shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, punitive, or other damages arising from or related to:

  • Use of the Service;
  • Inability to use the Service;
  • Reliance on evidence packs;
  • Fraudulent activity by users or third parties;
  • Misuse of evidence by any person;
  • Unauthorized publication of content;
  • False, misleading, manipulated, or fraudulent submissions;
  • Blockchain-related events;
  • AI-generated assessments;
  • Security incidents;
  • Loss of profits, revenue, business opportunities, data, or reputation.

13. User Responsibility for Misuse by Third Parties

Users acknowledge that Delphi Verify provides a technology platform and does not control how third parties may use, interpret, rely upon, distribute, misuse, manipulate, or present evidence generated through the Service.

To the fullest extent permitted by law:

  • Delphi Verify shall not be responsible for misconduct, misuse, fraud, criminal activity, malicious conduct, defamatory conduct, harassment, privacy violations, or other unlawful acts committed by users or third parties using information obtained through the Service;
  • Users agree not to hold Delphi Verify liable for damages, claims, losses, disputes, investigations, lawsuits, or legal proceedings arising from the actions, misuse, abuse, or malicious use of the Service by third parties;
  • Users expressly acknowledge that responsibility for the content submitted and the manner in which evidence is used rests solely with the individuals involved.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

14. Indemnification

You agree to defend, indemnify, and hold harmless Delphi Verify, its affiliates, officers, directors, employees, contractors, and partners from and against any claims, damages, liabilities, losses, costs, expenses, fines, penalties, or legal fees arising from:

  • Your use of the Service;
  • Your violation of these Terms;
  • Your violation of any law or regulation;
  • Your infringement of third-party rights;
  • Content submitted by you;
  • Any dispute involving evidence created, uploaded, published, or shared by you.

15. Suspension and Termination

Delphi Verify may suspend, restrict, or terminate access to the Service at any time, with or without notice, if we reasonably believe that:

  • These Terms have been violated;
  • Fraudulent activity has occurred;
  • Security risks exist;
  • Applicable law requires such action.

16. Changes to the Terms

We may modify these Terms at any time.

Updated versions will become effective upon publication on our website or within the Service. Continued use of the Service after publication constitutes acceptance of the revised Terms.

17. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Portugal, excluding conflict-of-law principles.

Any dispute arising from or relating to these Terms shall be submitted to the competent courts of Portugal, unless applicable law requires otherwise.
